ISLE OF MAN.

WHEREAS the existing Bye-Laws made in pursuance of the Acts of 11th Geo. 3, and 52nd and 54th Geo. 3, c. 143, have been found in many cases inefficient It is ordered that the same be revoked, repealed, and declared void, from and after the first day of January, 1854. And under and by virtue of the Powers contained in the said several Acts above recited, it is ordered and declared, That from and after the said first day of January, 1854, the following Bye-Laws, Orders, and Regulations, for the well governing, preserving, and regulating the several Harbours and Sea Ports of the Isle of Man, and for regulating piloting of Vessels and Boats plying in the several Harbours and Bays, be deemed and taken as the standing Bye-Laws, Orders, and Regulations, in lieu and stead of the said Bye-Laws, Orders, and Regu-lations, so revoked, repealed, and made void as aforesaid.

BYE-LAWS, ORDERS, AND REGULATIONS.

I. That any Ship, Vessel, or Boat, through mis-management or carelessness, running foul of any of the Piers or Wharfs of Her Majesty's Harbours in the Isle of Man, or any Part thereof, and damaging the Lamps or Lamp-posts, the Master shall, with all convenient speed, upon Notice given by the Harbour Master, repair such Damage, at the Charge of such Ship or Vessel, under the Penalty of double the Value of such Damages.

II. That no Chain Cables be used for the purpose of mooring Ships or Vessels in the Harbours, under a Penalty of any Sum not exceeding Two Pounds ; and the Master of any Ship or Vessel shall also, with all convenient speed, upon Notice given by the Pier Master, repair any Damage done thereby, at the Charge of such Ship or Vessel.

III. That no Ship, Vessel, or Boat, unload any Ballast into any Keel, Lighter, Boat, or Cart, or on any of the Quays or Wharfs within any of the said Harbours, without a sufficient Port Sail duly fixed and spread, under a Penalty of any Sum not exceeding Two Pounds.

IV. That no Ship, Vessel, or Boat, shall heave or deliver any Stones or Ballast into any of the said Harbours, under a Penalty, for every Ton, of any Sum not exceeding Two Pounds.

V. That no Person do heave any Stones, Dung, Ashes, Rubbish, or other Annoyances, into any of the said Harbours or Rivers, running within the Limits of any of the said Harbours, under the like Penalty of Two Pounds ; and if not immediately taken away or removed, upon Notice given, a further Penalty of any Sum not exceeding Two Pounds.

VI. That it shall and may be lawful to and for the said Harbour Master, his Assistant or Assistants, at all times hereafter, to give such Orders and Directions to all Ships, Vessels, Wherries, or Boats, as do, or shall, or may, at any time or times hereafter, come into the said Harbours, for their lying, mooring, anchoring, loading, shipping, or discharging of any Goods, Wares, and Merchandize, or in regard to the heaving out, or delivering, or taking Ballast; and the Government of the Shipping in all other respects whatsoever, within the said Harbours, as to them shall seem reasonable and meet. And that if the Owner or Owners, Master or Commander, or other Person assuming the command of any Ship or Vessel, Wherry or Boat, shall disobey such Order or Orders, and Directions, given him or them by such Harbour Master, or Assistant or Assistants, or shall refuse or neglect to obey and comply therewith, such Owner or Owners, Master or Commander, or other Person assuming the command of every such Ship or Vessel, Wherry or Boat, so disobeying, refusing, or neglect-ing to obey and comply therewith, shall for each and every such Disobedience of such Order or Orders, Direction or Directions, Refusal, or Neglect, forfeit and pay any Sum not exceeding Two Pounds. And also, in case of Disobedience to such Orders and Directions of the said Harbour Master, his Assistant or Assistants, in regard to the laying, mooring, or anchoring of any Ship or Vessel; or loading, shipping, or discharging of any Goods, Wares, or Merchandize ; that it shall and may be lawful to and for the said Harbour Master, or his Assistant or Assistants, to remove any such Ship or Vessel, Goods, Wares, and Merchandize, to such Place and Mooring as to him or them shall seem convenient or proper; the Expense whereof shall be defrayed by the said Harbour Master, or his Assistant or Assistants, and shall be repaid by the Owner or Owners, Master or Commander, or other Person assuming the command of every such Ship or Vessel; in default of which it shall be lawful for the said Harbour Master or Assistant, to retain a part of the Tackle, Furniture, or Apparel of such Ship or Vessel, until he pays the said Harbour Master or Assistant such expenses, by him or them incurred in removing such Ship or Vessel; and that no Person or Persons dare to obstruct or insult the Harbour Master, his Assistant or Assistants, in the Execution of his or their Duty, on pain of forfeiting for every such Offence, any Sum not exceeding Five Pounds.

VII. That no Person make a Fire upon any part of the Piers, to boil Pitch, or in any Vessel for the purpose of smoaking or destroying Vermin, or for any other purpose, without the consent of the Har-bour Master, on Penalty of any Sum not exceeding Three Pounds.

VIII. That no Clog Fenders be made use of by any Ships, Vessels, or Boats, within the Limits of the said Harbours, or any of them, unless hung horizontally, or length-ways along the Side of the said Ship, Vessel, or Boat, without the permission of the Harbour Master, on Penalty, for every Offence, of any Sum not exceeding Twenty Shillings.

IX. That any Person or Persons throwing off Ends, or cutting Hawsers or Junks, without the Authority of the Pier Master, shall, besides the Remedy the Parties damnified have by Law, forfeit for every such Offence, any Sum not exceeding Five Pounds.

X. That every Ship or Vessel coming into the Harbour, and having any Gunpowder on board, shall, after due Entry, immediately land and remove the same from within the Limits of the Harbour, on Penalty of any Sum not exceeding Ten Pounds, for every twenty-four Hours the same shall remain on board after arrival; and that no Fire or Light be kept on Board, while such Gunpowder remain on Board the Vessel, under a further Penalty of Twenty Pounds.

XI. That any Master or Masters, making any Dock or Docks, in the said Harbours, or any of them, for repairing of any Ship, Vessel, or Boat, or otherwise, do fill up the same in twenty-four Hours after the removal of the Ship, Vessel, or Boat; or for every twenty-four Hours they shall lie open after-wards, to pay any Sum not exceeding Five Pounds.

XII. That no Ship do unload any Ballast in the Harbour in the Night time, upon any Pretence whatsoever, under the Penalty of any sum not exceeding Ten Pounds.

XIII. That no Timber of any kind, or Plank for Sale, or any other Timber or Plank, but such only as shall be for the immediate use of Ships or Vessels when repairing ; or any Timber, Plank, or old Boats rendered unfit for Service; or Guns, or Pig Iron, or Stone, Bricks, or any other Incumberance whatsoever; shall be suffered to remain upon any of the Wharfs, Quays, or Piers, longer than two Days after the same shall be first laid there, on Penalty, for every Day the same shall lie there longer than the said two Days, after Notice given by the Harbour Master, of Twenty Shillings.

XIV. That Ships or Vessels going to sea, and wanting to take in Ballast, shall not be allowed to take the same out of other Ships or Vessels, unless by leave for that purpose, obtained in Writing from two Commissioners for the time being, but shall take the same out of some part of the Harbour appointed by the Harbour Master, under Penalty of Twenty Shillings for every Default.

XV. That Ships or Vessels heaving out their Ballast upon any of the Wharfs, shall cause the same to be carried away in Twenty-four Hours time, after Notice given by the Pier Master, to some Place without the limits of the Harbour : for every Day the same, or any Part thereof, shall remain there longer than the said Twenty-four Hours, to forfeit per Day, Five Shillings.

XVI. That all laden Ships or Vessels coming into the said Harbours to discharge their loading of Goods and Merchandize, shall have the preference of any Berths, in turns, until the said Cargoes are discharged . the Ships or Vessels of less Draught of Water, to haul highest up the Harbour.

XVII. That all Ships or Vessels taking in their full Loading of Goods and Merchandizes for outward-bound voyages, shall have liberty to take such Berths as are not then occupied by other Ships or Vessels discharging Inwards ; giving way to such laden Ships or Vessels as shall afterwards arrive.

XVIII. There shall be at least one Person on watch on board of each Ship or Vessel lying in any of the said Harbours, to take charge of such Ship or Vessel, while the same is afloat in any of the said Harbours, under the Penalty of any sum not exceed-ing Two Pounds.

XIX. That there shall be at least one Person on Deck of each Ship or Vessel lying at Anchor within any of the Bays of this Isle, under Penalty of any sum not exceeding Two Pounds.

XX. That no Person shall act as a Pilot, for the Piloting of any Ship or Vessel into any Bay, or into any Port or Harbour of this Isle, without having a Commission from Two or more of the Commissioners of Harbours; which said Commission is to be granted without Fee or Reward, to every Person applying for the same, on his producing a Certificate of his being duly qualified to act, from the Committee hereinafter mentioned, and giving Security for his good Behaviour in the Sum of Fifty Pounds. And that no Person shall attempt to Pilot any Ship or Vessel in any of the Bays, or into any of the Harbours of this Isle, without such Commission as aforesaid, on Penalty of Ten Pounds. zz Provided always, That this law shall not be construed to extend to authorized or com-missioned Pilots taken on board on the High Seas, or in any Port or Harbour in Great Britain or Ire-land ; nor to the compelling of any British Ship or Vessel to employ or pay for a Pilot, unless the Master or other Person having Charge of such Ship or Vessel, has by Signal or otherwise, signified his de-sire for the Assistance of a Boat or Pilot.

XXI. That the Commissioners of Harbours, or a Majority of them, shall appoint Two intelligent Ship Masters at each of the Ports of this Isle, who, together with the Pier Master at each of the said Ports, shall form a Committe to examine such Person or Persons as may be desirous of acting as a Pilot or Pilots as aforesaid, and who, (if after due Examination they find such Person or Persons qualified), shall grant a Certificate of such Qualification accordingly ; which Certificate must be produced to the Commissioners of Harbours previous to their giving any Commission to pilot Vessels as aforesaid.

XXII. That all and every Person, Occupier, or Possessor of any Lime Kiln, or Lime Kilns, House, or Houses, so situated as to be seen by Vessels at Sea, and the Light, or Lights of which, are liable to be Mistaken for Harbour Lights, whereby Ves-sels may be led into Danger, shall forthwith erect, or cause to be erected or made, sufficient Screens or Blinds thereto, so as to prevent the same from being so mistaken, upon Penalty of Five Pounds, on each Complaint made and substantiated before the Water Bailiff.

XXIII. That no Person shall fire or discharge any Gun, Musket, Swivel, or other Fire Arms, with-in any of the said Harbours, Piers, or Wharfs, (ex-cept on Days of Public Rejoicing, by special Leave from the Harbour Master), on Penalty of Ten Shil-lings.

XXIV. That no Boat shall act or ply for the carrying of Passengers to and from Vessels within the said Harbours and Bays, without a Licence signed by Two or more of the said Commissioners, and having the Name of the Owner, and Number of the Boat, painted in the Inside of the Stern thereof, under Penalty of Two Pounds. And that the Owners of such Boats shall be liable for the Misconduct of, or any Offence against the Laws of Harbours, committed by the Crews of the said Boats or any. of them.

XXV. That any Person or Persons occupying the Wharfs, Quays, or Piers, or any Part thereof, with Stalls or other Erections, or in any Manner en-cumbering the same, for the purpose of dressing or curing Fish, or in any other Manner whatsoever, or shall Deface the said Wharfs, Quays, Piers, or any Part thereof, or any Erections or Buildings thereto respectively belonging, by the sticking of Handbills, by spreading of Nets, baiting of Lines, or otherwise, without the Leave of the Harbour Master, or his Assistant, or Person in charge of, or having the Direction or Regulation of the said Wharfs, Quays, or Piers, shall be subject and liable to the Penalty of any Sum not exceeding Two Pounds for every such Offence.

XXVI. That such Rates of Pilotage shall be chargeable and recoverable only, as are set forth in the following Table. And that any Person or Persons demanding or attempting to enforce any higher Rates shall be subject and liable to a Penalty of any Sum not exceeding Two Pounds for each and every such Offence.

XXVII. All Vessels moored in any situation in the Harbours must allow the Ropes or Warps of Vessels hauling up, or down the Harbours, to be made fast to them, and by no means to cut or cast them off, while such Vessel is in the act of Warping, without the Harbour Master's orders, under Penalty of any Sum not exceeding Two Pounds.

XXVIII. Vessels of every description, including Fishing Boats and Luggers, on entering the Harbours are to run in their Jib-booms, and Mizen or Jigger-booms, and to keep them in while in Harbour, under Penalty of any sum not exceeding Two Pounds.

XXIX. That no Masts, Sails, Spars, or other Lumber be allowed to remain on the Quays without permission, or Ballast on the Steps, under Penalty of any sum not exceeding One Pound.

XXX. That the Free Stone Surface of the Pier, at Douglas, from the Guns downwards, having from time to time been much injured by the often un-necessary traffic thereon of Wheels bound with Iron, and the same, if further permitted, being likely to cause public inconvenience and injury; it is hereby ordered and declared, that if any Person or Persons shall in future use, or cause to be used, any Car or Truck, or Wheels shod with Iron, on the Free Stone Pier, at Douglas, from the Guns downwards, except with the express permission of the Harbour Master or his Assistant, such Person or Persons so offend-ing, shall, for every such offence, be liable to a Penalty of any Sum not exceeding Two Pounds.

All Masters of Ships and others, are required to take due Notice, that the above Laws will, for the future, be strictly put in Execution.
