Re: Message for JC re Robert & Jane Kellys' wills

Sad to say. I e mailed this will on December fourth, 2009 to a Canadian correspondent and for the life of me, I don't remember transcribing it but I present it here as I e mailed it. It is characteristic of me, that it is indeed my transcription but I cannot now vouch for it. Buyer beware.

In the name of god amen
I Robert Kelly of Ballavitchell in the Parish of Marown knowing and considering the uncertainty and frailty of this mortal life but being at present of sound mind memory and understanding do make publish and declare this to be my last Will and Testament in manner following:
First and principally I commit my soul
To Almighty God and my body to a decent
Christian Burial

Secondly I leave and bequeath unto
My daughter Jane Cannon wife of John
Cannon the sum of forty pounds which my
Executor hereinafter named is to pay her
By installments to her own whole and
sole use and free from the control of her
husband and her receipt to be a sufficient
discharge for the same unto my daughter
Elizabeth Gelling wife of James Gelling
The sum of one hundred Pounds unto
My daughter Catherine Cannell wife of
Robert Cannell the sum of one hundred
Pounds which said sum of five hundred
Pounds is mortgaged in the Estate of Balla-
Cottier the property of William Craine Braddan

Unto my son Robert Kelly the sum of
Ten Pounds unto my grandson John
Cowley Kelly the sum of two hundred
Pounds which said sum of two
Hundred Pounds is part of a Mortgage
on the Lands and Premises of William
Hampton Ballabunt in the Parish of
Braddan also the House and premises
On the Rock which I purchased from the
Late Hugh Clucas Coroner known by the
Name of Harry’s House and now in possess-
ion of James Kaye as yearly tenant
after the decease of my wfe Jane Kelly
and unto my granddaughter Margaret
Ann Kelly and Susannah Jane Kelly
the sum of one hundred Pounds each
which said sum of two hundred Pounds
is likewise part of the Mortgage on the
Lands and premises of William Hampton
and unto my Grandson Thomas Kelly
the sum of twenty six Pounds being part
of the mortgage aforesaid and unto
the poor of the Parish of Kk Marown the
Sum of three Pounds to be laid out on
Interest to the Vicar and Wardens for the
Use of the said poor forever and in
Case of Either of my granddaughters
Aforesaid, namely Margaret Ann Kelly

And Susannah Jane Kelly die before they
Arrive at the age of twenty one years
Or not married then in that case the
Said legacy of one Hundred Pounds
Is to go or be at the disposal of the survivor
And to become her legacy as the other
In case of no issue her surviving
Thirdly I leave and bequeath unto my
Beloved wife Jane Kelly the whole of
The furniture brought to my house by
Her likewise the sum of Three Hundred
Pounds in the Bank of Mona which kmy
Said wife is to receive herself after my
decease and her receipt is to be a sufficient
Discharge to the said Bank for the same
And my Executor herein after named is
Not to interfere in any way likewise
The interest on the Mortgage of William
Hampton’s lands and premises for this
Space or term of three years if she should
Survive that long but if she dies or departs
This life before that time or space aforesaid
then at her decease the said interest
is to go to my executor herein after named
likewise Harry’s House nor the House
and premises herein before bequeathed
unto John Cowley Kelly during his
natural life in lieu of his share

Or proportion of the stock and cash on
My said Estate of Ballavitchal belonging
to me at my decease and in lieu of all
bonds goods chattels and effects notes
money or any other property to which I may
possess at my decease in full as her share
or part of all my goods and effects as aforesaid’
And I do hereby nominate, constitute
And appoint my son Thomas Kelly
Whole and sole Executor and residuary
Legatee of this my Last Will and Testament
Of all the rest of my goods bonds mortgages
Notes chattels and effects moveable or
immoveable of whatever kind or description
Whatsoever or wheresoever situate barring
All claimants with two shillings and
Sixpence legacy as witness my name
This twenty fourth day of April 1861
