Deeds relating to Fort Anne


Extract from Shewood's Plan of 1849 - Douglas Head Road

The sequence of property transactions involving Fort Anne can serve as an example of the complexity of such arranngements - here they are organised in calendar order of deed and not that of the court through which they passed.

The various parties concerned include the Taubmans of the Nunnery - John Taubman (1723-1799) made considerable money from the running trade, his son John (1747-1822) was involved with early banking on the IoM, his heiress Isabella married Alexander John Goldie(d 1848), their son John(1804-1852) changed the family name to Goldie-Taubman by Royal assent in 1824. Thomas Whaley is considered elsewhere, Maria Courtney would appear to be relatively unknown to researchers tho one states she was a cousin of Capt Hugh Moore fellow traveller with Whaley to Jerusalem; Sarah Ann St John(1792-1845) was daughter of Ambrose St John(1760-1822) , but better known as companion to Sir Wm Hillary(1771-1847).

Thomas Stowell(1764-1821) who appears to have been advisor to Mary Whaley was Clerk of the Rolls and noted as a very able lawyer.

SSS May 1813 27 dated 30 Jul 1801;recites that Thomas Whaley(late of Douglas) + Maria Courtenay(Douglas, both now decd, did pass their jt bond dated 23 Jan 1798[ERD May 1798 45] to Major John Taubman(Nunnery) for £635(British) + said Maria Courtenay did by a deed annexed to sd bond transfer to sd John Taubman all those houses + concerns known as Fort Ann wch if sd bond was not paid within 8months it should be in power of sd John Taubman to cause sd premises to be sold by public auction - sd Maria Courtenay died soon thereafter and by her will devised the sd premises amongst her children by sd Thomas Whaley whom she appointed their guardian who prevailed upon sd John Taubman to advance a further £101(British) towards finishing of sd buildings - sd Thomas Whaley by deed dated 23 Sep 1799 transfered sd premises called Fort Anne to sd John Taubman and whereas the principal + interest + charges amounting to £858 becoming due + in arrears the sd John Taubman for £858 assigned sd deed to Thomas Stowell(Douglas); and as sometime ago sd Thomas Whaley also died leaving his widow the Honorable Mary Whaley testamentary guardian of his children by sd Maria Courtenay - sd Mary Whaley also sworn guardian of sd children by IoM Chancery Court; the premises called Fort Anne being in a very unfinished state, the sd Thomas Stowell with consent of sd Mary Whaley put the premises for sale by public auction at which Mary Whaley was highest bidder at £2500(British) - Thomas Stowell for the consideration of the sd £858 transferred all his right title to sd Mary Whaley;Witt Jas May, Hy Smith
ERD May 1813 87 dated 3 Dec 1812;John Taubman(Nunnery) and Mary Whaley(widow + exex of Thomas Whaley) proprietor of certain houses + concerns adj estate of the Nunnery [see SSS May 1811 50], have deemed it convenient to make following exchange: Taubman for consideration of £182 14s(British) being being the difference in value + £1 18s ground rent sell to Mary Whaley a part of the Bowling Green adjoining the road leading to Fort Anne from the gate at the west end of said road on the south, by the railing from the wall to the ditch erected by Forbes + Callow leading down to the sea on the west, the sea on the north and to the purchaser's own lands of Fort Anne in the east; Mary Whaley sells those 3 small gardens now or lately in possn of George Redfern bounded by the road leading to Fort Anne on the south, the sd Redfern's garden on west and the wall commonly called Whaley's Wall by the herring houses on north and sd land called the Bowling Green on east; Witt Thos A Corlett, John Clague

dated 27 Jul 1822;recites that Thos Whaley + Maria Courtney (then both of Douglas) gave B + S dated 23 Jan 1798 [ERD May 1798 45] giving as security Fort Anne, now sd John Taubman in consideration of sd principal, interest + charges + 5s assigns sd bond to Mary Whaley(widow of sd Thomas Whaley) and quit claims any right by deed dated 23 Oct 1820 [SSS May 1821 39]and notes that Taubman + Mary Whaley on 31 Jul 1801 [SSS May 1813 27] settled accounts re estate of Thomas Whaley whereby the sd £635 + interest + charges was charged against st Mary Whaley; the B + S dated 31 Jul 1801 has lapsed in law and Mary Whaley minded to pay all principal, interest + charges and gave as security until sd sum of £1000 + interest + costs repaid the sd Fort Anne, now John Taubman for sd payment transfers to sd Mary Whaley all his right title to sd Fort Anne; Witt Alexr John Goldie, John Caesar Gelling[notary public]

dated 20 Jun 1826;recites that Maria Courtney by deed dated 23 Jan 1798 purchased from John Taubman about 2ac of the Nunnery Howe as described in sd deed for £21 + ground rent £3 3s and bequeathed by her last will + testament the sd purchased lands equally to her four children Thos, Richard, Ann + Sophia Isabella Whaley and if any die under 21 yrs of age without issue then their share equally to the survivors and whereas the sd Thos Whaley died intestate without making any disposition of interest in his proportion and whereas sd Thos Whaley being illegitimate his right + interest in sd premises became forfeit to the Duke of Atholl as Lord of the sd said Island of Mann - but assents that will of sd Maria Courtney be carried into effect and the surviving brother and sister should possess the property and thus he quit claims any right to premises known as Fort Ann unto Sophia the wife of Robert Taylor, otherwise Whaley for her own use and for the use of Richard Whaley her brother being the only surviving children; Witt Robt Charles Carrington

dated 17 Jun 1831;Robert Taylor + wife Sophia als Whaley sell for £1400(British) to Thomas Lowey the tenement called Fort Ann as purchased by him from Mary Whaley by deed dated 24 Jul 1827 where sd concerns more fully laid out in a deed of sale + agreement between sd Mary Whaley and John Taubman(Nunnery) dated 3 Dec 1812, together with all grates, fixtures etc alread delivered to sd Thomas Lowry by Wm Ormsley; Witt Horatio A Carrington, Wm Ar Ormsly; annexed note dated 23 Mar 1831 that Robt Taylor complaineth agst Thomas Lowry and showeth he is sufficiently seized of lands + premises (+ grates, looking glasses, bells and greenhouses) of Fort Anne opposite to entrance of Douglas harbour + authorised Major John Ormsley(Douglas) to sell + dispose of same by public auction at Dixon's hotel on 20 Oct 1830 who entered into an agreement with Thomas Lowry(Liverpool) for £1400 a memo of which agreement dated 21 Oct 1830 between Ormsley(temporary resident at Fort Anne) + Thomas Lowry was witnessed by John Taggart (surveyor, Douglas) [Taylor resided in London] - Taylor notes that Lowry has complained that the title is defective Will Roper acting for complainaint

SSS May 1837 46 [Douglas - head] dated 23 Dec 1836; James Newton(Harold Tower) for a ground rent of £16 12s 6.5d(British) sells to Sarah Anne St John a parcel of land part of Harold Tower adj a parcel of land lately purchased by sd Sarah StJohn from sd James Newton by deed dated 14 Nov 1836 [SSS May 1837 47] on the NW bounded on end by road leading from Fort Anne to Douglas and on other by the sea shore and sd James Newton on SE - Sarah StJohn gives in security for payment of sd ground rent that dwelling house + lands called Fort Anne except that part called the Bowling Green - by this deed now unnecessary to construct the boundary wall mentioned in earlier deed tho the restrictions mentioned there to still apply - Sarah St John has liberty within 7 yrs to redeem + pay off the ground rent at 20yrs rent; annexed plan; Witt James Darkin, Charles Horton

dated 3 Feb 1846;recites that Sarah Ann St John(spinster, Douglas) did by deed dated 31 Dec 1831 grant a B + S to Thomas Lowry junr for £900 giving as security a mansion houses etc called Fort Anne and whereas sd John[sic] Lowry died intestate and father Thomas Lowry appt administrator who by deed dated 20 Aug 1833 assigned sd deed to James Holmes who by deed dated 31 Aug 1833 assigned sd deed to James McCrone (trustee appt under court of Chancery under a deed dated 16 Apr 1811 between Caesar Bacon , Ann Bacon + Cath Bacon and Richard Murray; and whereas Sarah Ann StJohn by deed dated 23 Dec 1833 passed a B + S for £268 12s 6d on sd Fort Anne except a strip 88yrds in length at west end of a field called the Bowling Green pt of field adj Glen leading to Nick Vane; James McCrone d abt 1840 where upon James Holmes by deed dated 23 Dec 1840 was appointed trustee whereby the two deeds passed by Sarah StJohn were united and on 7 Mar 1842 he obtained execution agt sd Sarah Ann St John for £1200 ; Sarah StJohn died shortly afterwards having appt Sir William Hillary exor - Holmes assigned sd two deeds to James Newton by deed dated 31 Oct 1845 who obtained execution agt sd Sir Wm Hillary for £178 3s 87d interest + for £845 + £211 8s 3d - all placed in hands of coroner who sold by auction sd Fort Anne + the two parcels of land at which James Quirk agent for James Newton was highest bidder at £1300; Witt James Spittall, G W Dumbell
