Duke to J.Sharpe. (copy) requesting information as to how far the new Act regarding the attestation of Will conveying real estate will affect the Bill filed by him against the Earl of Derby. The will of the late Earl of Derby was contested soon after his death, when the Duke of Atholl entered a caveat against it. The present Earl has petitioned the King and Council to the effect that the will of the late Duke gave the I.O.M. to him,and that by it the Duke of Atholl had no right to the Island. But the Duke,as heir at law,in July 1751 filed a Bill against the present Earl of Derby "setting forth that there was no will of the late Earl that precluded him from succeeding to all the other estates of the late Earl of Derby".
