Archdeacon Wills 1807 #27, of Dominique Lamothe of Castletown, surgeon:

‘In the name of God, Amen. I Dominique Lamothe of Castletown, surgeon, being of perfect and sound mind, memory and understanding at the making hereof but considering the uncertainty of this life, do make and ordain this my last will and testament in manner following. First, I commit my soul to Almighty God hoping through the mediation of my Saviour Jesus Christ to obtain remission of my sins and my body to be decently interred at the discretion of my executor herein after named and as to what worldly goods, chattels and effects it has pleased God to bless me with in this life, I give, devise and bequeath the same as herein after mentioned. Secondly, I give and devise unto my eldest son John Lamothe, his heirs and assigns all the house called Charles Pigot’s House wherein now dwell together with the yard between the same and the garden as far as to the eastward as the gable between the said Pigots house and that other House and concerns adjoining the same called Quaye’s Houses or concerns together with all that House called Isabel Fargher’s House with the yard to the same belonging, adjoining to the said Pigot’s House and also all that part of my garden adjoining the said Pigot’s and Fargher’s houses and yards extending from John Carin’s garden to the wall inclosing the said garden from the passage through Quay’s back concerns to the garden formerly belonging to the said concerns and from the corner or end of the said yard wall upon a direct line by the eastside of the walk in the said garden to the boundary wall of Richard Cubbon’s garden where a crab or thorn tree now grows. Thirdly, I give, devise and bequeath unto my son Frederick Lamothe, his heirs and assigns all that dwelling house commonly called Quay’s house, including as well the parts thereof occupied by myself as a parlour and best chambers or otherways as well as by my daughter Elizabeth Stowell widow together with the shed and yard behind the same as far as the westward xxx gable and back door of the said Pigot’s house and also the out offices to the said Quay’s house or concerns belonging together with the yard which lies between the said offices and the said garden wall and also all that part of my garden extending from the corner of the said yard wall upon a direct line with the eastside of the walk in the said garden to the boundary wall between the said garden and the garden of the said Richard Cubbon to the said crab or thorn tree which grows against the said boundary wall, and bounded on the westward by that part of my said garden hereby devised to my son John Lamothe. And whereas a part of that part of my garden devised to my son Frederick Lamothe formerly belonged to Pigot’s house now devised to my son John Lamothe. It is therefore hereby provided that in case my said son John shall disturb sxxx my said son Frederick, his heirs or assigns in the possession of any part of this devise to him, I do devise unto him the said Frederick the said Isable Fargher’s house with the yard and garden now or formerly belonging to the same. Fourthly, I give and devise to my son Henry Lamothe the sum of ten pounds British. I also leave and devise to my daughter Sophia Gelling the sum of twenty five pounds British. I also give and devise to my daughter Elizabeth Stowell the sum of twenty-five pounds British together with the feather bed, bed stead, curtains and bed clothes which she now has in her own possession. I also leave and devise unto my two daughters Susanna Lamothe and Rose Lamothe spinsters the sum of fifty pounds British each together with the two best feather beds, bed steads and each bed to be fully furnished with curtains and bed clothes and I do direct that the said several pecuniary legacies before said as soon as may e after my decease by my son Frederick Lamothe my executor herein after named his executors and assigns, and the better to enable him to pay the same I give and devise unto him the said Frederick Lamothe his heirs and assigns all that my whole field in Quay’s land containing by computation two daymoths and are[?] half of arable land. And I also devise and bequeath unto him the said Frederick Lamothe all the rest or residue of all my goods, chattels and effects whatsoever and wheresoever, and I do appoint him the said Frederick Lamothe sole executor of this my last will and testament. In witness whereof I the said Dominique Lamothe have hereunto subscribed my name this thirty first day of December 1803. [signed] Dominique Lamothe. Witnesses: Edward Cotteen, Robert Kelly. At an Eccliastical Court holden in the Parish of KK Patrick on the 30th day of January 1807, the executor is sworn in Court in form of Law and hath given pledges for the payment of the testators debts and legacies namely the said Edward Cotteen and Robert Kelly the witnesses of the will. To the Revd Evan Christian and John Crellin Vicars General of this Isle, the humble petition of Frederick LaMothe of Ramsay surgeon, sheweth that Dominique LaMothe of Castletown your petitioner’s father departed this life on or about the 8th of January instant and previous to his decease duly made and published his last will and testament in writing and therein and thereby after devising and bequeathing certain legacies to his other children, nominated and appointed your petitioner executor and residuary legatee, that several parts of the said decedents effects require an attention and interference which your petitioner cannot effectually undertake before he is sworn for the due execution of the said will which cannot be done best in public Court and with notice to the next of kin within this Island. Your petitioner therefore humbly prays that your Reverences may be pleased to appoint this petition to be heard on the next Court day and that your petitioner may be sworn executor of the said will in due form of Law of your petitioner shall ever pray etc. [signed] Frederick LaMothe. Ordered that the beforegoing petition do come on to be heard in the Court house in this Parish on Friday next whereof all proper xxx and persons to have and do be alive. Given at KK Patrick 28th Janry 1807. By Virtue of the Revd Vicar General Christian’s order granted upon the petition of Frederick Lamothe surgeon, I lawfully charged John Bridson of KK Arbory and Susanna Bridson otherwise Lamothe his wife to appear at a Court to be holden at the Court house near Thomas Quine’s in the parish of KK Patrick on Friday next to show cause if any they can why probate of the will of Dominique Lamothe deceased may not be granted. This I aver this 27th day of January 1807. [signed his mark] Thomas Hudgen Sumner of KK Arbory. By virtue of the Revd Vicar General Christian’s order granted upon the petition of Frederick Lamothe surgeon, I lawfully summoned Sarah Lamothe wife of John Lamothe who is now abroad, and Elizabeth Stowell otherwise Lamothe both of Castletown to appear at a Court to be holden in the court house near Thomas Quine’s in the parish of the Patrick on Friday next to show cause if any bthey can why probate of the will of Dominique Lamothe late of the said town deceased may not be granted.
