Archdeacon Wills 1798 #65, Andreas, of William Lace of Ballavoddan, Andreas:

‘In the name of God, amen. I William Lace of Ballavoddan in the parish of KK Andreas, being weak in body but of perfect mind and memory, do make this my last will and testament in manner and form following. First, I commit my soul to God and my body to Christian burial. Item, I leave and bequeath unto my daughter Esther a chest which lies upon the room over the parlour as legacy. Item, I leave unto my daughter Ann a chest which lies upon the room over the kitchen together with a feather bed which I sleep upon as legacy. Item, I leave and bequeath unto each of my seven children, namely William, Thomas, Elizabeth, Catharine, Jane, Esther, & Ann Lace the sum of ten shillings currency as legacy. Item, I leave and bequeath to my said son Thomas Lace all my tools and materials at my smithy or working shop, with all my shaped apparel as legacy. Item, I leave and bequeath, settle, estate, and confirm to and upon my said son Thomas Lace all and singular my rights to lands, houses, haggard, and gardens in the parish of KK Andrews as well quarterland, intack land, and purchased lands to be possessed by him at the decease of my loving wife Margaret Lace alias Christian, chargeable with the following sums, vixt., four pounds to my daughter Catharine, four pounds to my daughter Jane, five pounds to my daughter Esther and to my daughter Ann Lace, the sums to be paid unto them all within one year that my said son Thomas shall enter into the possession of the said lands and premises. Otherwise the said lands and premises to stand chargeable with and to be for full security xxx children for said sums or legacies. Item, I leave and bequeath the use and benefit of my lands, houses, haggard and gardens in the parish of Andrews to my loving Wife Margaret Lace during her life. Lastly, I nominate, constitute, and appoint my said wife Margaret Lace alias Christian whole and sole executor of the rest of my goods and chattels of what kind of nature moveable and immovable. In testimony whereof I hereunto subscribed my name this 19th February 1798. [signed] Wm Lace. Witnesses: Joseph Lace, Thomas Kneale.

At a Court holden in the Parish of KK Bride, the Executrix is sworn in Court in form of Law and hath given pledges for payment of debts and legacies namely the witnesses of the will. To the Reverent William Clucas one of the Vicar Generals of this Isle, &c., The humble Petition of Margaret Lace relict and widow of Wm Lace of KK Andrews lately deceased; Sheweth, that the said Wm Lace your Petitioner’s husband deceased, previous to his decease made his last will and testament and appointed you petitioner sole and whole Executrix thereof and your petitioner being well advised, that she cannot proceed to settle and manage the Estate of her said deceased husband until the said will be profected in your Revd. Court; Your petitioner therefor implores your Revd would be pleased to order the petition to come on to be heard in your Revd. Court with all convenient speed, and that the said will may be perfected in Law so as to enable your petitioner to proceed to settle her affairs respecting the said will in a just and legal manner and y our petitioner shall pray &c., &c. Ordered that the above Petition do come on to be heard at a court to be holden in the Parish of KK Bride on Friday next whereof all proper parties and persons to have due notice. I do hereby certify that pursuant to an order of the Revd. Vicar Genl Clucas on the petition of Margaret Lace, I charged Thomas, Cathrine, Jane, Esther & Ann Lace to appear before his Reverence at KK Bride on tomorrow by ten o’clock in the forenoon & to answer the suit of the above Margret Lace. This I aver this the 11th day of April 1798. [signed] John Radcliffe Sumner of KK Andreas.

To the Reverends John Christian and John Crellin Vicar Generals of this Isle &c., The humble petition of Margaret Lace of the parish of Andreas; Sheweth, That your Petitioner’s husband namely William Lace late of the said parish departed this life about one year ago, who previous to his decease made his will and appointed your Petitioner sole and whole executrix thereof, and hath been accordingly xxx such in form of Law; That several claims have been entered and sworn against the Estate of the decedent particularly by John Christian of KK Lezayre who hath lately enforced by order of xxxnal Court against your Petition for payment; That the decedent previous to his decease had sundry dealings and connexions the xxx by which your petitioner is apprehensive several demands will appear against the Estate of the decedent; and cannot with propriety xxx to the payment of debts until the time by Law for foreign creditors to prove their xxx against the said Estate which your Petitioner has been advised will not be legally expired until the end of three years, And your petitioner being apprehensive of a deficiency of assets to pay the said debts; Therefor humbly prays y our Reverences would be pleased to order this cause to come on xxx before your Reverences with all convenient speed. That your Petitioner may be allowed the time limited by Law for the payment of debts where foreign debts are like to be proved; and that in the meantime all proceedings of enforcing any order of the Ipintnal[?] Court against the Estate of the said decedent will be forthwith ordered to be stayed until the time limited by Law for a general dividend of the said Estate. And your Petitioner shall pray &c.

Ordered that the matters of this Petitioner do come on to be heard at a Consistory Court to be holden at KK Patrick on Thursday the 25th instant whereof all proper parties and persons to have due notice. Given at KK Michael this 16 April 1799. [signed] John Crellin.

At a Consistory Court holden in the Courthouse in the Parish of KK Patrick on the 25th day of April 1799: Upon hearing the Petition in the presence of parties and upon consideration xxx thereof as also of what was otherwise pleaded xxx alleged and admitted by them respectively it is hereby ordered adjudged and decreed that in case the effects of the said William Lace are not sufficient for the full payment and satisfaction of his debts already claimed and proved that the Register in whose custody the will and the inventory of the effects of the said William Lace are do forthwith ascertain penny-pxxx like the respective dividends of the Claimants who have established their claims against the Estate and that the Petitioner do pay the said dividends upon their entering into a bond under a reasonable penalty to refund so much of the said Estate as they will make all the Creditors thereof alike in case any more claims shall be entered and proved against the same, and it is likewise hereby further ordered adjudged and decreed that in case the said effects are sufficient for ful payment and satisfaction of all the present claims established against the said Estate, the Petitioner do forthwith pay the same upon the claimants entering into a bond as aforesaid and such subpoena juris with all fees.
