Archdeacon Wills 1787 #46, Patrick, of William Halsall of Ballaspick, Patrick, made 3 March 1787:

"In the name of God, amen. This is affirmed to be the last will and testament of William Hallsal of Ballaspick in the parish of KK Patrick, made and written on the 3rd day of March 1787, being in perfect mind and memory at the making thereof in presence of the subscribing witnesses.
First, he committed his soul to Almighty God and his body to Christian burial.
Item, he left and bequeathed unto his eldest son an heir William Hallsal all his purchased lands and intacks and all the houses thereon to be possessed by him at the expiration of seven years ensuing the decease of his Father the Testator, reserving the said purchased lands and the houses thereon during the said seven years for all his children to dwell and inhabit thereon that they may be kept and maintained to education and schooling.
Item, he left unto his three youngest children Thomas and Catherine and Anne the sum of eighty pounds which is in the hands of Thomas Cowle of Foxdale to be equally between them together with the areas of interest thereof except the sum of forty shillings that his aforesaid son William is to receive of the interest thereof for this present years. Lastly, he nominated and appointed his two daughters Ellinor and Margret Hallsal to be whole and sole Executrices of all the rest of his goods and effects of what kind soever moveable and unmoveable. Witnesses Philip Sayle, William Quirk. [signed his mark] William Hallsall.

At a Chapter Court holden at the house of Thomas Quine in KK Patrick, June 14th, 1787, The Executrices are sworn in Court in form of Law and also to be true and just the one to the other in the division of the effects, and likewise guardians and supervisors of their brother and sisters underage; Philip Clucas uncle to the children by the mother’s side is also sworn guardian of said children. They are also to bring a perfect inventory to the Registry and have given pledges for the payment of debts and legacies namely Philip Sayle one of the witnesses and Philip Clucas the guardian.

To the Reverend Evan Christian and the Reverend John Moore Vicar Generals of this Isle, The humble petition of Ellinor Halsall & Margret Halsall of the parish of KK Patrick; Humbly Sheweth, that whereas your petitioners are sworn Executrices and residuary legatees of the will and testament of their late deceased father William Halsall and are also sworn supervisors or guardians over three children namely Thomas, Catherine and Ann Halsall who are minors and under age and the goods left to the said children by the death of their father amounting to the sum of eighty pounds which is in the hands of thomas Cowle of Foxdale upon interest, and that William Halsall who is heir at law of his Father’s Estate and lands, your petitioners humbly beg that he may be sworn guardian over the said children along with your petitioners as he is at age and capable of choosing what guardians he is pleased over himself. Therefore your petitioners most humbly pray your Reverences will be pleased to take the matter of your petitioners to your judicious consideration and allow them the interest of the said children’s goods yearly and also the use of the said Estate or lands till the said children come to age towards maintaining and clothing them till they be able to support themselves and choose their own guardians or such part of the said interest and use of said lands as your Reverences shall seem meet which granted your petitioners as dutifully bound shall for your felicity ever pray &c. Ordered that the matters of the beforegoing Petition do come on to be heard at a Consistory Court to be holden in the parish of KK Patrick on the last Thursday in this month, whereof all proper parties to have legal notice and service. Given at KK Patrick 22nd day of Jun 1787. [signed] Ev. Christian.

At a Consistory Court holden in the Parish of Kirk Patrick on Thursday the 28th day of June 1787, The said William Halsal is sworn guardian and supervisor of the said Thomas, Catharine and Ann Halsal in form of law, and he, and the Petitioners are hereby allowed the principal and interest of the said minor’s fortunes and effects, as also use of the said Estate (as far as the Court have power to allow the same) for and towards the clothing, maintenance, and education of the said minors until they shall severally arrive at the age of fourteen years.

To the Revnd. Evan Christian Vicar General, the humble petition of Philip Clucas and Philip Sayle of the parish of KK Patrick; Sheweth, that your petitioners happened to bind themselves pledges for the Executors of William Halsal of said parish late deceased and now the Executors especially Matthias Crellin things to recover and receive all the goods and effects of the minor or orphan children of the said William Halsal into his own hands for which he the said Matthias Crellin has received an order from the Ecclesiastical Court against the said Philip Clucas for the sum of fifteen pounds being a part of twenty four pounds which the said Philip Clucas has of the said children’s goods which the said pledges look on to be unreasonable and contrary to equity to be given to him till he gives in new pledges for the payment of debt and good usage to the said children under age; Your Petitioners most humbly pray your Reverence will be pleased to grant them your authority to charge the said William Halsal’s Executors before your Reverence on some short day that the said order may be stayed till they give in new pledges which granted your petitioners duly bound shall pray &c.

Ordered that the before going Petition do come on to be heard before me at a Court to be holden in the house of Thomas Quine in this parish tomorrow, whereof all proper parties and persons to have notice. Given at KK Patrick 3rd July 1791. [signed] Ev. Christian."
