Archdeacon Wills 1765 #29, Jurby, of Thomas Clark of West Nappin, Jurby:

‘Whereas I Thomas Clark of West Nappin, Jurby, am now helpless in managing and cultivating the concern of lands to me belonging reserved in deed of settlement given by me to my son and heir William Clark bearing date the 13th June 1757, and I rexxx trust and have confidence in my son Patt Clark that he will prove dutiful and obedient and take care of me and … and help me in my febility and old age as well as manage and cultivate the premises according to my orders in plowing, tilling, sowing, harrowing, weeding and reaping during my life time; Know all men by these present that I Thomas Clark do set and let unto him my said son Patt Clark the arable land that is to be put under corn, he tilling and sowing and the rest of the work as afore mentioned and giving me half the corn dried and clean, ready for miln free but he hath the than for his pains, he is to have all things fill for food upon the halfs that is to say potatoes and garden upon the half and half of the pigs, geese, and all kind of fowl poultry and ducks as aforesaid, with my part of the easement about the house belongs, and my son William as is specified in his settlement with the parlour seller and brew house and half of what .. I allow to be cut being about four daymoth free … the haggard and such quantity of turf to the house as I shall order him to cut for our… upon the halfs as aforesaid. He is not to act contrary to my lawful orders in any thing or things but do all things for both our profit in an honest and just way, and keep the houses and fences and dreams in order and good repair. Secondly, he is to have the keeping of two milk kind half the milk butter and cheese, he is to have the . . . of said kind to himself for his own profit and he keep the increase of said kind he is to keep a work horse to work for us which I am to have … upon all … giving him his pasture … seasons. Likewise he is to have from me immediately the cart and a feather bed and bed clothes with the fir chest in the parlour. He is to have half of my part of the crops against next harvest as for the cart and bed, I am to have use of them both during my natural lifetime. Thirdly and lastly, if he the said Patt Clark proves a dutiful and obedient son as is specified in the preface and will be ruled by lawful orders and keep me in decent order as becomes rank, I shall not divide the fore mentioned things … And if God Almighty be pleased to call me with orders, my concerns be he my said son Patrick is to have all my … after my death. He is to live with me and take care of me, from the da of the date hereof as none of the rest of my children had proved so dutiful to aid help and take care of me in sickness and weakness as I have been left lonesome I am … he will for the … he will prove dutiful as he has got these conditions. And for the faithful and true performance of the foregoing covenants & conditions I the said Thomas Clark and also my said son Pat Clark do bind ourselves and our assigns in the penalty of twenty pounds … to be levied and paid according to the Law and custom of this Isle as will not our subscription this the thirty first May 1757. 8th August 1757, Thomas Clark & Patrick Clark acknowledged the within and above agreement and deed of setting to be his voluntary act and deed before me.

At a Court of Correction holden at KK Michael February 15, 1765, the annexed deed of agreement and setting between Thomas Clarke deceased and Patrick Clarke his son, wherein he also devises all his goods to his said son Patrick after his death, having been acknowledged before the Deemster, the same is accepted for the last will and testament of the said Thomas Clarke, and the said Patrick is thereupon sworn executor in Court in form of law, and hath given pledges for the payment of debts and legacies namely David Caine and Robert Christian both of the Parish of Jurby.’
