Archdeacon Wills 1763 #67, Jurby, of Daniel Gawne, died 20 Feb 1763:

‘This is affirmed to the ye last will and testament of Daniel Gawn who departed this life on or about ye 20th day of February 1763, being of perfect mind and memory at the making thereof. First, he committed his soul to God and his body to Christian burial. Also, he left his daughter Mary Gawn seven pounds of the the consideration money upon a mortgage held upon Cooil ne Roan, to be paid by his son Thomas Gawn when he should arrive at the age of twenty one years if the said lands should continue so long in mortgage. Also, he left to his son Thomas his part of the fore said mortgaged lands to be by him possessed when he should arrive at the age of 21 years if so be the said lands should continue in mortgage so long. But if the said lands should be redeemed before the time then mary was to have seven pounds and Thomas thirty shillings of the consideration money. He left also to his said son Thomas his half of the crop and husbandry gears and declared that he was not to possess any of his goods or effects till he would arrive at the age of twenty one years. Also, he left to his son Dan the sum of three pounds. Lastly he constituted and appointed his loving wife executrix of all the rest of his goods moveable and immoveable whatsoever and to the witnesses of this will one shilling each. Witnesses: Patrick Clark, Daniel Clark.

At a Chapter Court holden at KK Michael 3 Jan 1763, the executrix is sworn in Court in form of law and consents that the specific legacies left to her son Thomas shall be paid unto him when he comes to fourteen years of age as also the money left unto him, if the mortgage be redeemed at or before he arrives at the said age of fourteen years. The said Thomas & Daniel being both under age, the said children and their goods are committed to the executrix their mother, as none of the relations on the father’s side appeared to undertake the same. And she hath fortheld ends as also for the payment of debts and legacies given pledges namely Patrick Clark and Danl. Clark both of Jurby the witnesses of the will.

At KK Maughold, August 11th, 1773, this day Mary Gawn acknowledged to have received the legacy of seven pounds bequeathed to her by the within testator Daniel Gawn and doth hereby acquit, release and discharge the executrix of said Daniel Gawn of said legacy of seven pounds as witness her hand the day and date above written. [signed her mark] MarY Gawn. This day Daniel Gawn acknowledged to have received the legacy of three pounds bequeathed him by the last will of the within testator daniel Gawn in legacy, as witness his has the day and date above written. [signed his mark] Daniel Gawn’
