Archdeacon Wills 1741 #34, Malew, of Nicholas Shimmin of Greneby, Malew, made 10 Mar 1740/41:

‘KK Malew: The last will and testament of Nicholas Shimmin of Grainaby, being sick in body but at perfect mind and memory at the making hereof. First, I bequeath my soul to God and my body to the earth in hopes at the general resurrection to receive the same again by the mighty power of God that gave it, and as for my worldly goods and effects, I give and bequeath the same in manner following. Item, I bequeath unto my son and heir all the purchased lands to descend as heirship form heir to heir to which my wife gives her consent that her part thereof shall fall and descend in like manner. Item, I bequeath unto my said son half the husbandry gears with seed to sew the ground, he my said son paying unto my executors the sum of ten pounds. Item, I bequeath unto my son Robert and daughter Isable four pounds each. Item, I bequeath John and Charles my two sons all the rest of my goods moveable and immovable whatsoever whom I do also appoint my executors and this only to stand for my last will and testament, any will heretofore made to the contrary notwithstanding, in witness whereof I hereunto set my hand this 10th day of March 1740/41. Not before the signing hereof that I bequeath unto my loving wife my riding horse as legacy. [signed] Nicho. Shimin, & [signed her mark] Joney Shimin. Witnesses: Thomas Gawn, William Stole.

Charles one of the executors being sick, John his brother is sworn in Court to be just in division of the goods and payment of debts and legacies, and to this end hath given pledges William Stole and Tomas Fawn the witnesses of this will. Pledges in the place of William Stole are John Quayle B.Trollag & Patrick Quayle.

I John Waterson of KK Malew husband of the withing named Isabel Shimmin daughter of the within testator Nicholas Shimmin do hereby acknowledge to have received the four pounds legacy left and bequeathed unto my said wife by her said father. And I do hereby release and qcquit the within named John & charles Shimin executors of the said Nocholas Shimin and their heirs, executors, administrators and assigns thereof forever. As witness my mark to my name this 25th July 1764. [signed his mark] John Waterson. In presence of John Gill Archdeacon Registrar.

Mr. Charles Shimin to William Shimin: Cash given to you [total] 7 pounds 2 shilling 9 pence; Cash given to brother John: 3 pounds. [dated] May 8th, 1762. The above William Shimmin has made oath that he has paid the sum of ten pounds unto the executors of his father Nicholas Shimin upon account of the purchased lands left unto him by his father, vizt., 3 pounds to John & 7 pounds to Charles. Before me Robert Radcliffe.

At KK Arbory November 28, 1772, John Shimmin & Charles Shimmin, executors of Nicholas Shimmin this day acknowledged that they were fully paid and satisfied by William Shimmin their brother for the ten pounds bequeathed unto them by their Father Nicholas Shimmin’s will, and hereby release him the said William Shimmin accordingly before me.
