Archdeacon Will (parents Donold Qualtrough & Margaret Killey) & Catharine Clark (parents Thomas Clark & Margery Cannell), part of will 1666#14 of Catharine Qualtrough als Clark:

"THE 18 OF JUNE 1653: ARTICLES OF MARRIAGE agreed and concluded upon betwixt THO: CLEARK of KK Malew with the consent of his WIFE MARGERY CLEARKE ALIAS CANNELL on the one party: And DONOLD QUALTHROUGHT of the parish of KK Lonan with the consent of his WIFE MARGREAT QUALTHROUGHT ALIAS KILLEY on the other party as followeth: First, it is agreed that the sd THO: CLEARKE with the consent of HIS WIFE MARGERY CLEARKE ALIAS CANNELL doth give in bargain of contraction to one eldest DAUGHTER KATHERIN CLEARKE after our decease the whole tenement the whole crop of corne whole plow with all geares belonging to the sd tenement, and also what lands we have bought to the sd tenement to be the only exemption what land and houses I have of Castletowne wch I keep to my own disposing till my latter day: further it is agreed yt this can agree that ould people shall have the xxx power during their lives, If not then the young copple is xxxxxx[torn page] the tenement ho--- the crop of corn, xx the xxx of oxens with sd geares belonging to the sd tenement ----soe it is agreed ---at four[?] could xx right time shall be taken out of the whole crop of corn for my youngest DAUGHTER wo--ing[?]: if she be not married before it pleaseth God to call for me: Alsoe I doe convenant and promise: if I doe marrie again And get xxxx xx pay xx my eldest DAUGHTER KATHERIN HER HUSBAND or their issue sixty pounds in lieu of her inheritance: Moreover I doe promise to make my ELDEST DAUGHTER KATHERIN CLEARK as deepe in execut--- as any of the rest of my CHILDREN at my latterday an to ha--- good[?] is forre one the tenement: As wittness my hand and sign the day and year above sd: THOMAS X CLEARK. Secondly it is agreed upon that the sd DONOLD QUALTHROUGHT with the consent of his wife MARGREAT QUALTROUGHT ALIAS KILLEY doe promise to give xxx portion to our son DONOLD QUAILTROUGHT twenty pounds sterling: to be xxxx xxx within 3 or 4 years, & be executors of half my goods at my last day: of all that is debtless goods: As witness my hand and sign the day and year above. DONOLD QUALTROUGH, MARGRETT QUALTROUGHT ALIAS KILLEY her mark X. WHEREAS IT IS WITHIN SPECIFIED that KATHERINE CLARKE shall be equal in the executorship of THOS: CLARKE with his other CHILDREN, the meaning thereof is and further agreed upon that if it please God to call for the sd THOS: CLEARKE before his youngest DAUGHTER ELIZABETH CLEARKE shall be married then she is xxx xxxx for her porcion out of the whole or his part afterward, his DAUGHTER KATHERIN to be joint executors as is within written. THOS: CLEARKE X his mark, DO: QUALTHROUGH. Witness hereof: Tho: Norris, Jo: Lewen xxxxx. MARGERY THE WIFE OF THO: CLEARKE hath given full consent to give to her DAUGHTER KATHERIN CLEARKE her half of the team of oxen, crop of corn and all kind of husbandry geares belonging to the sd Tenement xxxxxxxxxx and xxxxx bargain[one line is torn through and mostly unreadable]. "KK Malew, October 22th 1666, Curia 3rd: The last will and testament of CATHERINE QUALTHROUGH ALS CLARKE who committed her soule to God, and her bodie to Christian burial.
Item, she bequesthed to the poore three halfe ferletts of corne.
Itemm, she bequeathed to her HUSBAND DANIEL QUALTHROUGH her half of the rideing horse.
Item, she bequeathed all the rest of her worldly goods moveable and immoveable whatsoever to her only CHILD ISSABLE QUALTHROUGH whome she constituted her true and lawful Executrix.
Item, she appointed and constituted her owne FATHER THOMAS CLAREK supervisor of her said CHILD. Testes: Tho: Clarke jur, juratus, Wm Quiggin & John Shimmin jurati. THE SUPERVISOR SWORN in court, soe also ye FATHER to bring in a perfect inventory within a month subpoena 10s ad xxxxxx.

MAY YE 31TH 67: ROBT JOYNER entereth his claimn against ye Executor of CATHE QUALTROUGH for ye sum of thirtie shillings lent moneys, due debt: & craveth tryall.

MAY 31, 67: WILL: CALOW of KK Maughold enters against ye said Executor for 10s 6d due debt as he will appear & craveth xxxxx xx xxx paid.

MAY 31, 67: DONLL QUALTROUGH JUNOR of KK Lonan entereth his claime against the said executor for the sum of 10s due debt and craveth tryall.

MAY 31, 67: JAINE CUBBON of KK Arbory enters against ye said executor for the sum of 2s 6d due debt & craveth xxxxxxxx. EODE DIE: RO: LEWNE enters his claime against ye said executor 2s 6d & craveth tryall. EODE DIE: PHILLIP COWIN of Lonan enters against ye said executor 1s 6d, & craveth tryall. THE INVENT WITH SECURITIES are placed in the twelfe leafe after ys annexed to the order of the Court.

A PERFECT INVENTORY OF YE GOODS OF KATHERINE CLERK ALIAS QUALTHORAUGH given in and praised by 4 sworne men vid: Wm Quail, Tho: Cowine, Ro: Corrin, & Wm Cluage Sumner:
The one oxe praised to 00 pounds : 8 shillings : 0 pence;
Ite, a cow praised to 0:7:0;
Young steer of 3 year old & dam: a calfe of halfe a year ould pra: 0:5:0;
Young horse pra: to 0:7:0;
Young mare praised to 0:1:0;
Sheep and goates pra: to 2:4:0;
Halfe a barrel praised to 1:0:6;

THE DEBTS of ye decedents part amount to 02:01:00.

To ye worshipful Hen: Nowell Esq dep---- Governor of this Isle, & to ye rest of ye xxxx officers now in Court, The humble peticion of THO: CLARK & HIS WIFE: Sheweth, That whereas your peticioners is dayly troubled by DON: QUALTROUGH about a certayne contraccion bargain which your peticoners gave ye sd QUALTROUGH with THEIR DAUGHTER, in hopes they would be an help to them in their old age (but on ye contrary) yt hope xxx in a great discomfort & several tymes your p---- offered unto ye sd QUALTROUGH this last havuest[?] xxxxx come receive & enter upon ye benefit of yt Co--- (before ye officers) in Court, desiringe likewise ----ame on the other side, wch ye sd QUALTROUGH refused wch now your peticioners humbly conceives xxxxx selves not any way oblidged to perform cond---- in respect ye sd QUALTROUGH so oft refused ye same. Therefore your peticioners humbly xxxx desires your worships to take y--- promises into your serious consideration whereby a full hearinge may be xxxxx of ye sd business & yt your peticioners xxx have & order or reference to close or acquit ye sd QUALTROUGH of them touchinge ye sd Contract, whereby they may not be troubled any longer in ye business, & your peticioners shall as in xxxxx bound and pray, &c.

THERE BEING A HEARING formerly of the within Contraction before the Court, The within DANIELL QUALTROUGH & his then WIFE wholly relinquished their interest therein upon any condition, But that the within THOMAS CLARKE & HIS WIFE should keep all themselves & that the sayd QUALTROUGH & WIFE want not trouble them, upon wch the Court might lawfully proceed to an order in the premises, with consideracion of some other circumstances, But in respect that this day both the said THOS CLARKE & HIS WIFE xxx upon their part and DANIEL QUALTROUGH upon his part (his WIFE being dead) having agreed this day, to give in sufficient securitie for the forthwith coming of all goods & other particulars due to the CHILD, according to their engadgments in the said contraction bargaines and the goods remaining in the keeping of the said DANIELL QUALTROUGH (whereof an Inventory is taken) therefore this agreement to be a finall conclusion betwixt them to xx remaining in his ye said DANIELLs keeping until the CHILD come to age, The said THOS: CLARKE & HIS WIFE giving ye like securety for the team of oxen crop of corn & husbandry geares, in case shee ---es to xxxxxx the same either at their death or her marriage with their full & free consent and not otherwise; And this upon the faithfull promises & engagement[?] & security given by ye sd THOMAS CLARKE. Witn: Edw: xxxxx & Henry Wainwright both of Kk Malew, before us, Tho: Norris, Hen: Norris, R. Calcott, Rich Tyldesley.

AT CASTLETOWN 7TH JUNE 1667: AGREEMENT BETWIXT THO: CLARKE & DONOLD QUALTROUGH ye sd DONOLD QUALTROUGH is to have & enjoy ye goods free mencioned in ye within -ertor--[?] during ye minority of ISSABLE QUALTHOUGH ye execr who when she cometh to years of 14 years of age is to enjoy ye same according to ye Laws of this Isle; for the faithful performance & forthcoming thereof ye said DONOLD QUALTROUGH hath given securitye JO: BARRY of Castletown & PATR CHRISTIAN of KK Lonan & to keep ye office harmless subpoena double ye value, ad vsw. docimin. In respect of some difference betwixt DONOLD QUALTHROUGH & THO: CLARK concerning a Contracion bargain given by the said THO: CLARKE & HIS WIFE and upon the agreement thereupon b---- as upon the back of ye sd Contract more at lardge appear xxxx The above securitye is taken & do find to be accepted of by ye Spiritual Court by us, Hen: Norris, Richd Tyldesley, Tho: Norris, R. Calcott."
