South Side Sale, May 1770 #65 Malew

Thos Harrison (Coronr) to William Kinley

Whereas John Kewn Shoemaker of Castletown & Catherine
his wife Borrowed and Received from Wm Kinley of the parish
of KK Arbory the sum of twelve pounds manks.  And for
the said Kinleys better Security They, the said John Kewn
and Catherine his wife passed over and assign’d unto him a 
certain house & Broken walls in Milln street in Castletown
as Counter security as appear’d by a Bond Bearing Date
the 2nd Day of July 1760.  And whereas the said Kinley
had occasion for his said money, and that said Kewn &
wife could not Procure cash to pay the same where? upon the
said Kinley obtained the worshipful Deemr Taubman’s token to sell
said security for to make payment of his forsd sum.  And
Delivering the same unto Thos Harrison Coronor of Rushin –
Sheading to Execute the same.  The said Coronor according
to Practice Charged a Jury of four me for to Value and Estimate
sd security.  And forasmuch us that sd Jury Rated the – 
premises at so High a price That no one wou’d not Bid for
at a Lower price  But upon hearing of the matter – 
at a Chancery Court Hold in Castle Rushin on the 8th Day 
of April 1763 It was then ordered that the premises should
Be sold for the Highest price that Cou’d be had or Gotten
for the same.

Therefore Know all men by these Presents That I Thos Harrison Coronor
of Rushin Sheading By Vertue of my office and Pursuant to an order
from the Honerble Court of Chancery Bearing Date the 8th Day of April 1763
at an auction appointed upon that occasion for Sundry Reasons But
more Especially for and In consideration of the full and Just Sum of Eight
pounds manks Currency which said sum Being the Highest sum Bidd on
for the same to be paid at By and from the Hands of  Wm Kinley of 
the parish of KK Arbory  Have Given Granted Bargained and sold – and
Do by these presents Give Grant Passover and forever absolutely
sell unto him the said Wm Kinley his Heyrs Executors adminstrators &
assigns from me the said Thos Harrison coronor all the Right title property
and Interest that the said John Kewn & Catherine his wife now have
unto a Certain House and Broken walls situate in milln street Castletown Joyning
to James Walkington’s on the North and to Thos Cowleys on the west, to Widdow

Cannels on the south and to the street? on the East of the annual Lords
Rent of four pence be the same more or Less to Have and to Hold unto him the
said Wm Kinley the formentioned premises with all ways water courses
Easements & Liberties Profits and advantages Belonging to the same
and I the said Thos Harrison coronor by virtue of my office and pursuant
to said order do uphold and awarrant the premises against the 
pretended Rights of any person and for the True and faithful performance
of the [?] premises all partys herein Concerned Do hereby Bind and
oglige themselves in and under the penalty of fourty? pounds [obscured by fold]
to Law as witness our Names & Subscription the 4th Day of July 1763

The before written Deed of Sale being acknowledged before the
Deemster & now openly published in Court & no objection
offered against it the same therefore is allowed of for in
the Name & Behalf of the most Noble John Duke of Atholl
& Charlotte Duchess of Atholl Lord & Lady of the Manor [digital image edge]
