Thomas Christian to Samuel Kinley

Know all men by these presents that I
Thos Christian & Charlotte Christian my wife of
the Garey in the parish of KK Christ Lezayre
for and in consideration of the Just and Entire
sum of Thirty five pounds of good and lawful
money according to the currency of this Isle to be
paid at the worshipful Deemster’s attestation – 
hereof at by and from the Hands of Samuel Kinley
of the parish of KK Andreas – Have therefore – 
Given, Granted, alienated, passed over and Sold;
And by these presents Do Give Grant alienate
passover and forever absolutely Sell unto him the
said Samuel Kinley his Execrs and assigns all – 
and singular a certain parcel or parcels of our – 
Estate of the Curraugh or Balla-Churry commonly 
distinguished by the name or names of Gatten-
begga as the same are already bounded and fenced
about Situated lying and being in the said – 
parish of KK Andreas and adjoining to the – 
highway and the Purchaser’s own Land on the
East, to Lough-Hamm on the South East, to Wm
Radcliffe’s Lands and John Radcliffe’s purchase
on the South and South west, to my own meadow
and Spoddagh on the west, and to that part of
my said Estate called Close-y-Geil on the North,
the premises being Intack Land and the yearly
Rent thereof to be after the proportioning of the – 
Setting Quest from me the Said Thos Christian – 
and Charlotte my wife aforesaid our Heirs Execrs

admrs and assigns, To Have and to Hold – 
unto him the said Samuel Kinley his Heirs – 
Execrs admrs and assigns the premises aforesaid
and Every Individual part thereof with the – 
whole Issues & profits thereof together with all
ways, waters and watercourses, Easements, Liberties
and appurtenances to the same belonging or in – 
any wise appertaining forever as aforesaid commenc
-ing from the Day of the Date hereof – He the said – 
Samuel Kinley the purchaser his Execrs and assigns
yeilding and paying yearly and Every year – 
such annual Lord’s Rent as the Setting Quest – 
shall adjust upon the premises and doing and
performing all other Dues & Duties annually – 
incumbent upon the Same at times & seasons – 
usually accustomed forever as aforesaid – 
I the said Thos Christian and Charlotte my wife
aforesaid obliging our selves to be of full power and
capacity to do make & Execute this Deed of Sale – 
to defend maintain uphold and warrant him – 
the Said purchaser his Executrs and assigns forever
in the peaceable possession of the premises and – 
every part thereof against the pretended Right,
Title Claim or Demand of any person or persons – 
Whatsoever from by or under us – and further to – 
do perform and Effectually perfect Execute and – 
finish any other act or Deed that at any time – 
hereafter may appear necessary or Requisite – 
(Either in Law or Equity) for his the said purchaser’s

better Security, and Holding of the premises – 
forever as aforesaid – And for the true & faithful
performance ^of^ all and singular the above written &
before going Deed of Sale and Every article Clause – 
and sentence therein contained, Both parties vizt
I the said Thos Christian and Charlotte my wife – 
aforesaid and I the said Samuel Kinley do here=
by firmly bind and oblige our selves the Either party
to the other and our Respective Heirs Execrs admrs
and assigns in and under the penalty & forfeiture
of seventy pounds sterling to be levied and paid – 
according to the Law and customs within this Isle – 
in all cases of this Nature – as witness our Re=
spective names hereunto Set and Subscribed this – 
the Third Day of October in the fifth year of the Reign
of our Soverign Lord George the ^Third^ of Great – 
Britain, France and Ireland King Defender of the
Faith &c and in the year of our Lord God 1765. –

within written Deed of Sale to pay the yearly Rent
of Two pence half peny As witness our names

The beforegoing Deed of Sale being acknowledged before the Deemster &
now openly published in Court and no objection offered against it, the
same is therefore allowed of, for and in the Name and behalf of the
Most Noble John Duke of Atholl and Charlotte Duchess of Atholl
Lord and Lady of the Mannor, and confirmed by this Court
